Terms of Use & End User License Agreement

1. Apple's Standard EULA & Required Terms

Voltare's Apps are licensed, not sold, to you. Each App is also subject to Apple's Licensed Application End User License Agreement (the "Apple Standard EULA"), which is incorporated into these Terms by reference. Where these Terms and the Apple Standard EULA conflict, the term that is more protective of the User's statutory rights controls; otherwise these Terms supplement the Apple Standard EULA. For clarity, the following minimum terms apply to every App you obtain through the Apple App Store:

1. Acknowledgement. These Terms are concluded between you and Voltare only, and not with Apple. Voltare, not Apple, is solely responsible for the App and its content. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
2. Scope of license. The license granted to you for the App is a limited, non-transferable license to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing where applicable.
3. Maintenance and support. Voltare is solely responsible for providing any maintenance and support services, as specified in these Terms or as required under applicable law. Apple has no obligation to furnish any maintenance and support services.
4. Warranty. Voltare is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
5. Product claims. Voltare, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including: (i) product-liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer-protection, privacy, or similar legislation.
6. Intellectual property rights. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Voltare, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
7. Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
8. Developer name and address. Questions, complaints, or claims with respect to the App should be directed to Voltare (Kaleb Simpson) at [email protected].
9. Third-party terms. You must comply with applicable third-party terms of agreement when using the App.
10. Third-party beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

2. License Grant & Scope

Subject to your compliance with these Terms, Voltare grants you a personal, non-exclusive, non-transferable, revocable, limited license to download and use the App on Apple devices you own or control, solely for your own lawful, personal, non-commercial use. You may not: (a) copy, modify, or create derivative works of the App; (b) reverse engineer, decompile, or disassemble the App except to the extent applicable law prohibits this restriction; (c) rent, lease, lend, sell, sublicense, or otherwise transfer the App; (d) remove or alter any proprietary notices; or (e) use the App to build a competing product or service.

3. Eligibility & Accounts

Coalescence is strictly for adults aged 18 or older. By creating a Coalescence account you represent and warrant that you are at least 18 years old, that all information you provide is truthful and accurate, and that you will keep it current. You may maintain only one account, and you may not create an account if you have previously been banned. You are responsible for activity that occurs under your account. We may verify age and identity signals and may refuse, suspend, or terminate any account at our discretion.

4. Code of Conduct & Content Rules

You agree to treat others with respect and to use the App only for lawful purposes. When using Coalescence or any App that lets you submit content or interact with others, you must not create, upload, post, send, or otherwise share any content that:

1. Is nude, pornographic, sexually explicit, or sexually suggestive; depicts genitalia, exposed breasts or buttocks, sexual acts, or is otherwise graphic in nature. Profile photos and messages must be appropriate for a general adult audience and must not be explicit.
2. Is violent, gory, or graphically disturbing, or that promotes, glorifies, or incites violence, self-harm, or harm to others.
3. Sexualizes, endangers, or exploits minors in any way, or constitutes child sexual abuse material (CSAM). This is strictly prohibited and will be reported to the appropriate authorities, including the National Center for Missing & Exploited Children (NCMEC).
4. Is harassing, bullying, threatening, hateful, or discriminatory toward any person or group on the basis of race, ethnicity, national origin, religion, disability, gender, gender identity, sexual orientation, age, or any other protected characteristic.
5. Is false, misleading, or impersonates another person, uses someone else's photos, or otherwise misrepresents your identity (catfishing).
6. Is commercial spam, solicitation, advertising, prostitution or escort services, a financial scam, a pyramid scheme, or a request for money, gifts, or financial information.
7. Promotes illegal activity, the sale of illegal or regulated goods (including drugs, weapons, or counterfeit items), or violates any applicable law or the rights of any third party.
8. Contains malware, or seeks to collect, harvest, or publish others' private or personally identifying information without consent (doxxing).

You also agree not to use bots, scrapers, or automated means to access the App, not to circumvent any moderation or rate-limiting measures, and not to interfere with the App's security or operation.

5. Zero Tolerance for Objectionable Content

We will act on objectionable-content and abusive-user reports and remove offending content and/or eject the offending user, where appropriate, within 24 hours of becoming aware of it. We may also take action proactively. Determinations of what is "objectionable" are made by us in our sole, reasonable discretion. Removal of content or termination of an account under this Section does not entitle you to any refund.

6. Moderation, Reporting & Blocking

To keep Coalescence safe, we provide the following:

• Content filtering. Photos are screened on your device using Apple's Sensitive Content Analysis and Vision frameworks before they can be uploaded, to help filter explicit imagery. We may apply additional automated and manual review.
• Reporting. You can report any profile, photo, or message that you believe violates these Terms directly within the App. We review reports and respond to concerns in a timely manner.
• Blocking. You can block any user at any time, which prevents further contact.
• Contact. You can also reach us at [email protected] to report content or abuse, or to appeal a moderation decision.

We reserve the right, but assume no obligation, to monitor, review, hide, remove, or restrict any content, and to suspend, ban, or remove any user, for any reason, with or without notice.

7. Your Content & License to Us

You retain ownership of the content you submit (your photos, profile details, prompts, and messages). You represent and warrant that you own or have all necessary rights to the content you submit and that it does not violate these Terms or any third party's rights. You grant Voltare a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your content solely as needed to operate, provide, and improve the App (for example, displaying your profile to other users as part of the dating service). This license ends when your content or account is deleted, except for content already shared with other users and to the limited extent we must retain records as described in our Privacy Policy. Your private messages are end-to-end encrypted, and we do not have the keys to read them.

8. Safety & In-Person Meetings

You interact with other users and meet them in person at your own risk. Always meet in a public place, tell a friend or family member where you are going, arrange your own transportation, and never send money or share financial information. We do not guarantee the conduct, identity, or intentions of any user. If you feel you are in danger, contact local emergency services immediately. You agree that Voltare is not responsible or liable for the conduct of any user, online or offline.

9. Subscriptions & Billing

Coalescence offers a free tier and optional auto-renewing subscriptions: Plus at $0.99/month and Max at $4.99/month (prices may vary by region and are shown in the App before purchase). Subscriptions are sold and processed by Apple through your Apple Account:

• Payment is charged to your Apple Account at confirmation of purchase.
• Subscriptions auto-renew unless turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription at any time in your Apple Account settings. We cannot cancel an Apple subscription on your behalf.
• Refunds are handled solely by Apple in accordance with the Apple Media Services Terms and Conditions; except where required by law, payments are non-refundable.
• Inactivity. Free accounts inactive for 30 days are deleted. Paid accounts inactive for 30 days have their premium benefits downgraded and the account removed; on days 25–30 we send daily reminders with a one-tap link to manage or cancel your subscription. Removing your profile does not itself cancel an Apple subscription — you must cancel it in your Apple Account.

10. Intellectual Property

The App, including its software, design, text, graphics, logos, and the "Coalescence" and "Voltare" names and marks, is owned by Voltare and protected by intellectual-property laws. Except for the limited license granted to you in these Terms, no rights are transferred to you. You may not use our names, logos, or trade dress without our prior written permission.

11. Disclaimer of Warranties

The App and all related services are provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Voltare does not warrant that the App will be uninterrupted, secure, error-free, or that it will meet your requirements, or that any matches, interactions, or relationships will result from your use of the App. Any material obtained through the App is accessed at your own discretion and risk.

12. Limitation of Liability

To the maximum extent permitted by law, in no event shall Voltare or Kaleb Simpson be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or for personal injury, emotional distress, or damages arising from the acts or conduct of any user (online or in person), arising out of or relating to your use of or inability to use the App, whether based on warranty, contract, tort, or any other legal theory, even if advised of the possibility of such damages. To the maximum extent permitted by law, Voltare's total aggregate liability for all claims relating to the App shall not exceed the greater of (a) the amount you paid Voltare for the App in the twelve months before the claim, or (b) twenty U.S. dollars ($20). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Voltare and Kaleb Simpson from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the App; (b) your content; (c) your violation of these Terms; (d) your violation of any law or the rights of a third party; or (e) your interactions with any other user, including any in-person meeting.

14. Termination

These Terms remain in effect while you use the App. You may stop using the App and delete your account at any time in Settings; account deletion is immediate and permanent. We may suspend or terminate your access at any time, with or without notice, for any violation of these Terms or for conduct we determine is harmful to other users, us, or third parties. Sections that by their nature should survive termination (including Sections 7, and 10–15) survive. As described in our Privacy Policy, if your account is banned for safety violations we retain only a one-way hash of your Apple identifier and minimal report details to prevent return; no profile content or photos are kept.

15. Governing Law & Disputes

These Terms are governed by the laws of the State of South Carolina and applicable U.S. federal law, without regard to conflict-of-laws principles. Subject to applicable law and any non-waivable consumer rights, you agree that any dispute not subject to the Apple Standard EULA's terms will be resolved in the state or federal courts located in South Carolina, and you consent to their jurisdiction. Nothing in these Terms limits any consumer-protection rights that may not be waived under the law of your place of residence.

16. Changes & Contact

We may update these Terms from time to time. Material changes will be posted on this page with a revised "last updated" date, and your continued use of the App after changes take effect constitutes acceptance.
